Boise County Files Bankruptcy

The following press release was sent to Garden Valley Daily News from the Boise County Board of Commissioners:

On December 17, 2010, in Alamar Ranch vs. Boise County, a federal jury awarded a four million dollar ($4,000,000) judgement to the Plaintiffs. An appeal is pending. Plaintiffs' attorneys fees and costs were awarded additionally. The request sought is approximately one million four hundred thousand dollars ($1,400,000). The Court has not yet determined the amount to be awarded. County representatives participated in many discussions with the Plaintiffs in an effort to resolve this litigation prior to trial. Given the nature and extent of the Plaintiffs' demands, the parties were never able to reach an agreement.

The Board of Commissioners had been working diligently to assess the county's resources and determine if it can satisfy the judgement. There have been several meetings between the Plaintiffs and Boise County Commissioners regarding the judgement and possible resolution. No such resolution has been reached thus far.

The County has Constitutional and Statutory duties and obligations, including paying for indigent sick, roads, jails, courts, solid waste programs, and other services. The Board of Commissioners has determined that it cannot satisfy the judgement and continue to operate and satisfy the County's legal obligations and provide basic services to County residents with the amount of resources available.

The Plaintiffs have stated that they will immediately proceed to execute on the judgement and seek the County's operating cash in order to satisfy the judgement. In order to ensure the continuous operation of Boise County, the Board has determined to file Chapter 9 Bankruptcy and seek relief though the bankruptcy process.

    ALDER CREEK BRIDGE DESIGN UPDATED: Public Meeting
    GARDEN VALLEY – Based on new traffic volumes and projections, the updated South Fork Payette River Bridge design has a reduced width, different than what was previously presented.

    A public open house is scheduled for March 2 at the Crouch Community Hall, 342 Village Circle. The public is invited to stop by anytime between 4 and 6 p.m. Project team members will be on hand to answer questions and receive comment.

    The 82-year-old South Fork Payette River Bridge (also known as the Alder Creek Bridge, Silver Bridge or Wetzel Bridge) is deteriorated to the point that it is structurally deficient and functionally obsolete.

    Boise County and the Local Highway Technical Assistance Council (LHTAC) are working with J-U-B ENGINEERS, Inc. of Boise to design and prepare a bid package for construction of the new bridge, anticipated for 2012.

  5. Erik Oaas lost his million dollar home in the gated community at 9460 West Pebble Brook Lane in Garden City to the Bank of America in a foreclosure action in January of this year. What goes around always comes around...the laws of Karma are always in action..
